By decree of February 9, 2011 the GUP of the Court of Salerno has ordered the indictment of two officials of a leading bank, on charges of usury (art. 644 cp) aggravated by the fact that he acted in the banking business.
This proceeding arose as a result of a complaint from the businessman, who established by appraisal prepared by the technical accounting Kipling sas the application of effective rates in excess of the limits of the law.
The findings of the report of them have been confirmed in the conclusions reached by the CTU appointed in criminal proceedings.
From 1 April 1997, following the entry into force of Law 108/96 are published quarterly on the G.. U. the so-called threshold wear rates. These rates are clearly the limit el'illecito between the lawful, therefore they transcend one of the main requirements for the integration of the crime of usury.
This determination can only be done by determining the rates of charge, possible only with the help of specially designed computer procedures.
